Chapter 1 General Provisions

Article 1 [Acceptance of Terms and Conditions]
Howon EPS (hereinafter referred to as “Company”) provides its services on the condition that the customer accepts the company’s terms of service (hereinafter referred to as “Terms of Service”). The Terms of Service may be updated at any time without notice, and customers can check the latest version of the Terms of Service at any time at www.foreon1.com.

Article 2 [Purpose]
① The purpose of the Terms of Service is to stipulate matters regarding the requirements and procedures for using the Internet service (hereinafter referred to as “Service”) provided by the Company, as well as other necessary matters.

Article 3 [Application of Terms of Service] These terms and conditions apply to the use of all of the company's services, and matters not specified in these terms and conditions are subject to the provisions of the Framework Act on Telecommunications, the Telecommunications Business Act, the Act on Promotion of Information and Communications Network Utilization, etc., and other related laws.

Article 4 [Definition of Terms]
① The definitions of terms used in these terms and conditions are as follows.
1. “Customer information” refers to personal information such as user name, contact information, email address, and account number that a customer registers with the company when concluding a service agreement with the company.
2. “Service suspension” refers to the temporary suspension of the service use agreement for a certain period of time according to the needs of the Association.

Chapter 2 [Conclusion of Service Use Agreement]

Article 5 [Application for Use]
① Customers who wish to use the service must record the required information in the membership application form on the company website.
② All information that customers enter in the subscription application form is considered to be actual data, and customers who enter false information will not receive legal protection and may be restricted from using the service.

Article 6 [Establishment of Use Agreement]
① The use contract is established upon the customer’s application for use and the company’s approval.
② The service agreement is concluded per user ID.
③ The contract unit is one user ID per person.

Article 7 [Customer consent to use of information]
①The company must collect the minimum amount of personal information, such as name, contact information, and account number, necessary for establishing and implementing the service contract through legal and fair means.
② When a customer applies for use in accordance with these Terms and Conditions, he or she is deemed to have agreed that the Company will collect, use and provide the member information stated in the application for use in accordance with these Terms and Conditions and that the personal information protection policy established by the Company will be applied to his or her information collected by the Company.
③ Customers can view, edit, add, and delete personal information at any time through the user information modification page.

Article 8 [Disapproval of application for use and restrictions on approval]
①The company does not approve applications that fall under any of the following items.
1. When applying in someone else’s name or under a non-real name
2. When applying by attaching false documents or filling out false information
3. When it is difficult to approve use due to other reasons attributable to the customer applying for use.
4. If the application is made for the purpose of disrupting social order or morals
5. When the application requirements set by other companies are not met
② If an application for service use falls under any of the following items, the Company may not approve the application until the reasons for restricting approval are resolved.
1. When the company does not have enough equipment
2. If there is a technical problem of the company
3. In cases where it is difficult to approve use due to other company circumstances
③ If the application for use is not approved or acceptance is restricted pursuant to the provisions of paragraphs 1 and 2, the company must immediately notify the applicant.

Article 9 [Changes in Use Agreement]
① If there are any changes that fall under any of the following items among the terms of use agreement submitted or entered when concluding a service agreement with the company, the customer must notify the company without delay or access the service and make the changes himself.
1. Contact information and account number
2. Other changes to customer information
②The company may change the user ID by agreement with the customer in any of the following cases.
1. When there is concern about privacy infringement because the customer's contact information, account number, etc. are registered
2. If it causes disgust to others or goes against public morals
3. If there are other reasonable grounds.

Chapter 3 [Use of Services]

Article 10 [Service usage time]
① In principle, the service is available 24 hours a day (00:00-24:00), 365 days a year, except in special cases for business or technical reasons. However, this does not apply to days or times set by the company, such as regular inspections of equipment.
②The company may set the available time for each service content, and in this case, the content will be announced through the service.

Article 11 [Restrictions and suspension of service use]
①The company may restrict or suspend the provision of services in the following cases.
1. When war, incident, natural disaster, or similar emergency occurs or is likely to occur
2. When the company determines that it is necessary to limit or suspend the provision of services due to unavoidable reasons such as regular inspection of equipment or failure of dedicated lines.
3. If there is a disruption in the use of the service due to a failure of the service facility or excessive use of the service.
4. If the company wishes to restrict or suspend the use of the service, the company will specify the reason, period, target equipment, etc. and notify users without delay.
② If a customer falls under any of the following items, the company may restrict or suspend part or all of the use of the service and may delete the resulting data without recovery.
1. If the customer does not fulfill his/her obligations stipulated in these Terms and Conditions
2. When transmitting a large amount of information for the purpose of interfering with the stable operation of the service or continuously transmitting advertising information against the recipient's will
3. When distributing computer virus programs that cause malfunction of information and communication facilities or destruction of information, etc.
4. In case of infringement on the intellectual property rights of the company, other users, or a third party
5. When there is a request for correction from an external organization such as the Information and Communications Ethics Committee or when an authoritative interpretation is received from the Election Commission in relation to an illegal election campaign
6. When personal information such as user ID and confidential information of another person is used illegally
7. When information obtained using service information is copied, distributed, or used commercially without prior consent of the company
8. When engaging in an act that violates relevant laws, such as telecommunications laws
9. In case of intentional interference with the company’s service operation
10. If the registered name is not your real name
11. When one customer registers twice with different IDs
12. In case of intentionally disseminating content that is detrimental to public order and morals
13. If you commit an act that damages the reputation of others or puts them at a disadvantage
14. When a customer posts pornographic material or links to a pornographic site on his/her homepage or bulletin board
15. In case of violation of other terms of use set by the company, including these terms and conditions
16. In case of violation of Article 13
③ If the company intends to suspend use in accordance with the provisions of paragraph 2, it will determine the reason, date, and period and notify the customer through services, etc. at least 7 days prior to suspension of use. However, this does not apply if the company deems it urgently necessary to suspend use.
④ If a customer who has received a notice of suspension of use pursuant to the provisions of paragraph 2 has an objection to the notice of suspension of use, he or she may file an objection to the Association.
⑤ The company may temporarily postpone the suspension of use until the period for confirmation of the objection pursuant to the provisions of paragraph 4, and notify the customer of the result.
⑥If the company confirms that the reason for suspension has been resolved during the period of suspension, the company will immediately lift the suspension.

Article 12 [Retention and use period of collected personal information]
1 If the 'Service' collects personal information from customers, the retention period and use period is from the time the customer directly applies for membership until the time the cancellation is processed after expressing the intention to cancel.
2 When the purpose of collecting personal information has been achieved, the 'Service' destroys the personal information without delay and recommends that third parties who have legally received personal information from the 'Service' also comply with this. However, the following cases are exceptions.
① When there is a need to preserve it in accordance with the provisions of laws such as the Commercial Act
② If the retention period is notified or specified in advance to the customer and the retention period has not elapsed
③ When consent is obtained from individual users

Chapter 4 [Rights and Obligations of Contracting Parties]

Article 13 [Obligations of the Company]
①The company does not send advertising emails for commercial purposes without the consent of the customer.
② The company must maintain the service facilities installed in the company to ensure that they are suitable for continuous and stable service provision, and if a failure occurs in the service facilities or the facilities become unusable, the company must immediately repair or restore the facilities.
③ If the company deems that opinions or complaints raised by customers are justified, it must immediately process them. However, if immediate processing is difficult, the reason must be notified to the customer.
④The company cannot disclose or distribute customer information acquired in connection with service provision to others without the customer's prior consent, and cannot use it for purposes other than service-related work. However, exceptions are made in the following cases:
1. When there are special provisions in laws such as the Act on Real Name Financial Transactions and Guarantee of Confidentiality, the Act on Use and Protection of Credit Information, the Framework Act on Telecommunications, the Telecommunications Business Act, the Local Tax Act, the Consumer Protection Act, the Bank of Korea Act, and the Criminal Procedure Act.
2. When requested by the Information and Communication Ethics Committee
3. When it is necessary for statistical compilation, academic research, or market research and is provided in a form that does not identify specific individuals
⑤ Notwithstanding the provisions of Paragraph 4, if the Company wishes to use the customer's personal information or provide it to a third party beyond the scope notified or specified, the Company must individually notify the customer in writing or by e-mail and obtain consent.
⑥The company strives to provide convenience to users in terms of procedures and contents related to contracts with users, such as concluding a service agreement, changing contract terms, and terminating the contract.

Article 14 [Customer Obligations]
① Customers must comply with the matters stipulated in these Terms and Conditions and the service usage guidelines and precautions.
② Customers must immediately update their registration information if any changes occur. If the information provided by the customer or updated information is inaccurate, or if you have committed any other act specified in Paragraph 3 of this Article, the Company may restrict or suspend the customer's use of the Company's services in accordance with Article 11 of these Terms of Service.
③ Customers agree not to use the service for the following actions.
1. Any act that causes harm to others (including minorities)
2. Posting, posting or e-mailing vulgar or obscene data, text, software, music, photos, graphics, video messages, etc. (hereinafter referred to as “Content”)
3. Acts of impersonating someone else and falsely stating a relationship with another person
4. Posting, posting or e-mailing content for which you do not have rights (all rights including intellectual property rights)
5. Posting unnecessary or unauthorized advertisements or promotional materials, or soliciting, posting, posting or e-mailing “junk mail,” “spam,” “chain letters,” “pyramid schemes,” etc.
6. Posting, posting or e-mailing software viruses to destroy, interfere with, or limit the functionality of computer software, hardware, or telecommunication equipment.
7. Posting, publishing, e-mailing, etc., materials containing other computer codes, files, or programs.
8. Collecting or storing personal information of other users
9. An act of defaming a person by stating true or false facts for the purpose of slandering the person
10. Distributing false information for the purpose of providing property benefit to oneself or others or causing damage to others
11. Gambling or gambling with money
12. The act of arranging prostitution or distributing information that mediates fornication
13. An act of interfering with the other person's daily life by continuously sending words, sounds, texts, images, or images that cause shame, disgust, or fear to the other person
14. The act of stealing and using another person's information and communication service name
15. Other illegal or unfair acts
④ Recognizing the global nature of the Internet, customers agree to comply with local regulations regarding online conduct and acceptable content.
⑤ Customers agree not to copy, duplicate, sell, resell or use the service itself, use of the service, or access to the service for commercial purposes.

Article 15 [Assignment and management of user ID, etc.]
① All responsibility for managing user ID and password lies with the customer who owns the user ID.
② All responsibility for disadvantages such as negligence in using the service caused by the user ID or illegal use by a third party lies with the customer who owns the user ID. However, this does not apply if the company is intentionally or grossly negligent.
③ The company performs customer management tasks using user ID as the basic unit.
④ User ID cannot be shared or transferred. If a customer shares or transfers the user ID without prior consultation with the company, the company may suspend the user ID.
⑤ If their ID is used illegally, the customer must notify the company of the fact.

Article 16 [Management of Use Data]
① If the company determines that the information registered by a customer violates Article 13, it may delete it after giving prior notice to the customer. However, this does not apply in cases of emergency or unclear contact information.
② If necessary, the company may set a period for registered data for each service content, and if the registration period exceeds the specified period, it may be deleted after notification. However, this does not apply in cases of emergency.

Chapter 5 [Restrictions and Suspension of Services]

Article 17 [Contract Termination and Restrictions on Use]
① If the customer falls under any of the following items, the company may terminate the service agreement or restrict the use of all or part of the service without prior notice.
1. If the customer does not fulfill his/her obligations stipulated in these Terms and Conditions
2. When transmitting a large amount of information for the purpose of interfering with the stable operation of the service or continuously transmitting advertising information against the recipient's will
3. When distributing computer virus programs that cause malfunction of information and communication facilities or destruction of information, etc.
4. In case of infringement on the intellectual property rights of the company, other users, or a third party

Chapter 6 [Copyright]

Article 18 [Rights to published materials]
① The rights to materials posted on the service are as follows.
1. The intellectual property rights of materials posted or registered within the service by the customer belong to the customer. However, the company has the right to publish it within the service.
2. Rights and responsibilities for posts belong to the publisher, and customers cannot use them for purposes other than the service without the consent of the publisher.
3. Customers may not use the information obtained through the service for reproduction, performance, broadcasting, exhibition, distribution, publication, etc. or provide it to third parties through copying, processing, translation, derivative work, etc., other than for the customer's personal use.

Chapter 7 [Compensation for Damages]

Article 19 [Disclaimer]
① The Company shall not be liable for any damages arising from the customer's failure to obtain the expected benefits from the provision of the service or from the customer's choice or use of the service materials. However, this does not apply if the customer proves the existence of reasons attributable to the company, such as illegal provision of information, intent, or negligence.
② We are not responsible for the reliability or accuracy of information provided through the service network provided by the company.
③ The company is exempt from all liability arising from the content of materials posted or transmitted by customers.
④ The company is exempt from liability for any problems arising from product transactions between users or between users and third parties through the service.

Supplementary Provision 1. (Enforcement date) These terms and conditions will be effective from September 1, 2023.
